This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.madhuramstores.com website.
The domain name www.gurujisrimuralidharaswamigalmission.org (hereinafter referred to as “Website”) is owned by Guruji Sri Muralidhara Swamigal Mission, a Trust having its registered office at Plot No 11, Door No 4/11, Netaji Nagar Main Road, Jafferkhanpet, Chennai – 600083, Tamilnadu, India.
Your use of the Website and services and tools are governed by the following terms and conditions ( “Terms of Use” ) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. These terms and conditions shall be binding on each user/participant and/or donor for the worldwide territory who voluntarily desires to make monetary donations to GSMSM. If You transact on the Website, You shall be subject to the policies that are applicable to the Website for such transaction. By mere use of the Website these terms and conditions including the policies constitute Your binding obligations, with GSMSM.
For the purpose of these Terms of Use, wherever the context so requires “You” or “User” shall mean any natural or legal person who has agreed to become a buyer on the Website by providing Registration Data while registering on the Website as Registered User. The term “We” , “Us” , “Our” shall mean GSMSM.
1. Agreement
By using the Website you agree to be bound by these Terms.
2. Amendments
We reserve the right to:
(a) update these Terms from time to time and it is your responsibility to check for such changes. The changes will apply to the use of the Website after we have given such announcement. If you do not wish to accept the new Terms you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms; and

GSMSM offers its magazine Madhuramurali on subscription basis to its subscribers. Unless explicitly stated otherwise, any new features that augment or enhance the current Service shall be subject to this Terms and Condition. You understand and agree that GSMSM assumes no responsibility for the timelines, misdelivery or failure to store any user communications or personalization settings or deliver the magazines in time.

4. Use of the Website
You agree, undertake and confirm that Your use of Website shall be strictly governed by the following binding principles:

(i) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
(j) shall not be false, inaccurate or misleading;
(k) shall not create liability for Us or cause Us to lose (in whole or in part) the services of Our internet service provider (“ISPs”) or other suppliers;
(l) You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. We reserve Our right to bar any such activity.
(m) You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Website or to any server, computer, network, or to any of the services offered on or through the Website, by hacking, password “mining” or any other illegitimate means.
(n) You shall not probe, scan or test the vulnerability of the Website or any network connected to the Website nor breach the security or authentication measures on the Website or any network connected to the Website. You may not reverse look-up, trace or seek to trace any information on any other User of or visitor to Website, or any other customer, including any account on the Website not owned by You, to its source, or exploit the Website or any service or information made available or offered by or through the Website, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your own information, as provided for by the Website.
(o) You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us including the terms GSMSM or otherwise engage in any conduct or action that might tarnish the image or reputation, of GSMSM or otherwise tarnish or dilute any GSMSM’s trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us. You agree that You will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Website or Madhuram Stores’s systems or networks, or any systems or networks connected to Madhuram Stores.
(p) You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on the Website, or with any other person’s use of the Website.
(q) You may not forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal You send to Us on or through the Website or any service offered on or through the Website. You may not pretend that You are, or that You represent, someone else, or impersonate any other individual or entity.
(r) You may not use the Website or any content for any purpose that is unlawful or prohibited by these Terms of Service, or to solicit the performance of any illegal activity or other activity which infringes the rights of GSMSM and / or others.
(s) You shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules thereunder as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT/GST, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your subscription to our service and donations made by you.
(t) We reserve the right, but have no obligation, to monitor the materials posted on the Website. GSMSM shall have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. Notwithstanding this right, you remain solely responsible for the content of the materials you post on the private messages. Please be advised that such Content posted does not necessarily reflect GSMSM Stores views. In no event shall GSMSM Stores assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Website.
(u) It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Website and that You may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about You due to your use of the Website, and that the recipient may use such information to harass or injure You. We do not approve of such unauthorized uses, but by using the Website You acknowledge and agree that We are not responsible for the use of any personal information that You publicly disclose or share with others on the Website. (v) GSMSM shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally.

When you choose to donate or subscribe for the magazine on this Website, we will ask you to input personal details in order for us to identify you, such as your name, e-mail address, billing address, delivery address, credit card or other payment information.
6. Protecting Your Security
To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases.
We take the risk of internet fraud very seriously. With the volume of fraudulent credit card transactions increasing, we make every effort to ensure all orders are thoroughly checked using the information already supplied. There is a possibility we may contact you to make additional security checks and we ask for your co-operation to enable us to complete them. 8. Subscription for the Magazine
The magazine subscribed for on the Website is not for re-sale or distribution. We reserve the right to cancel subscription and/or suspend accounts where we believe the subscription is made in breach of this provision.
We accept no liability where you provide an incorrect delivery address or where you fail to collect the magazine from the delivery address which you specified.
11. Price and Payment
Subscription prices shown on the Website for the subscription are inclusive of taxes, if any, wherever applicable. We reserve the right, however, to change prices at any time without notice to you (save that any changes will not affect orders already placed).
Payment for the subscription and the donations can be made through any major credit or debit card or through any other means provided by the payment gateway provider, enabled in this website. Payment will be debited and cleared from your account before the magazine is circulated and delivered.
In the unlikely event that the price shown on the checkout page is wrong, and we discover this before accepting your order, we are not required to deliver the magazine to you at the price shown. We always try and ensure that the prices of magazine shown on our Website are accurate, but occasionally genuine errors may occur. If we discover an error in the subscription price that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it.
You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us we will not be liable to you for any delay or non-delivery.
Please familiarise yourself with these terms and conditions before you place an order as we reserve the right to reject or cancel any orders which do not comply with these terms even if your credit or debit card has been charged.
12. Eligibility to Subscribe or make payment
By offering to subscribe to our services and/or making payment, you represent to us that you are 18 years of age or over and authorise us to transmit information (included updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.
13. No Refund Policy
All payments made on website either for the subscription or as donation are final and are not refundable.

As a convenience to our customers, the Website may include links to other websites or material which is beyond our control. For your information, we are not responsible for such websites or material nor do we review or endorse them. We will not be liable, whether directly or indirectly, neither for the privacy practices or content of such websites nor for any damage, loss or offence caused or alleged to be caused in connection with, the use of or reliance on any such advertising, content, products, materials or services available on such external websites or resources.
15. Intellectual Property
The content of the Website and content supplied thereof is protected by copyright, trademarks, database and other intellectual property rights and you acknowledge that the material and content supplied as part of the Website shall remain with us or our licensors.
You shall promptly notify Us in writing upon your discovery of any unauthorized use or infringement.
16. Disclaimer Of Warranties and Liability
You agree that we shall have no liability to You for the Website if You find the same to be offensive and/or objectionable.
Notwithstanding any other provision in the Terms, nothing in these Terms:
While availing any of the payment method/s available on the Website, GSMSM will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
1. Lack of authorization for any transaction/s, or
2. Exceeding the preset limit mutually agreed by You and between “Bank/s”, or
3. Any payment issues arising out of the transaction, or
4. Decline of transaction for any other reason/s
All payments made against the purchases/services on Website will be made through our Payment provider, CCAvenue and your payment data will be collected and processed securely by them for transfer of payment.
The Website is provided on an 'as is' and 'as available' basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Website and any information provided by you. You must bear the risk associated with the use of the Internet.
Whilst we will try to ensure that material included on the Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website. GSMSM does not warrant that this site; information, Content, materials, product (including software) or services included on or otherwise made available to You through the Website; their servers; or electronic communication sent from Us are free of viruses or other harmful components.
17. Indemnity
You agree to fully indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms by you, or any other liabilities arising out of your use of this Website or any other person accessing the Website using your personal information.
18. Severance
If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms.
19. Waiver
No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.
20. Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India and any disputes will be decided only by the Courts in Chennai.
21. Dispute Resolution
Without prejudice to any provisions in the terms and conditions herein, any dispute arising in relation to the terms and conditions will be submitted to a sole arbitrator appointed by Guruji Sri Muralidhara Swamigal Mission under the provisions of the Arbitration and Conciliation Act, 1996 and rules framed there under (including amendments in force). The venue of Arbitration shall be at Chennai.
